Last week, Oak Lawn Police responded to a report of a hit and run traffic accident. The intoxicated suspect later refused a breath test, attributing her failure to blow into the machine to her inexperience performing fellatio.
On Sunday, March 27th, 2016, officers responded to the 90th block of 49th Ct after a victim reported a hit and run traffic crash. The victim related that the suspect, Marcia Matejka, had been driving a white Pontiac Grand Am when she struck his vehicle at the intersection of 91st St & 54th Ave. Matejka then left the scene without making any attempt to speak with the victim.
The victim proceeded to follow and locate Matejka as she pulled into the driveway of her home. The victim identified Matejka to the police as she stood beside her damaged vehicle.
Matejka advised police that she was the at-fault driver. She had been involved in the accident and had left the scene because she needed to use her home’s restroom. Officers noted that Matejka was very unsteady on her feet and spoke in a confused manner and with a slur, and that she had urinated in her pants. Officers also noted that Matejka had bloodshot and glassy eyes and the strong smell of alcohol upon her breath.
Officers administered the Horizontal Gaze Nystagmus and the Walk and Turn tests to Matejka, but she refused the One Leg Stand test. Matejka agreed to take a Preliminary Breath Test on scene, but then refused to blow directly into the mouth piece, instead blowing out of the corner of her mouth or not at all. When officers advised Matejka that they believed she was over the legal limit of 0.08% blood alcohol content, Matejka exclaimed that she knew she was over the legal limit.
Officers then placed her under arrest, handcuffed and transported Matejka to jail for processing. Once at the jail, refused to sign a Warning to Motorist form. She then began to cry and bang the back of her head against a wall, stating that she should not have been arrested because “the f***ing illegal Mexicans in the other car crossed over the line.”
Matejka later consented to breath testing again, but instead spit into the breathing tube, causing the instrument to cancel the test. Attempts were subsequently made twice more. In all attempts, Matejka either blew too gently or pretended to blow without exhaling. Matejka repeatedly informed officers that she “wasn’t good at blowing because” she “never gives head.”
Matejka was charged with improper lane use, hit and run, and driving under the influence of alcohol. Her vehicle was towed and impounded by Jack’s Towing.
