A man was accused of stealing a soda, prior to the repeal of the soda tax, and when provide opportunity
to pay to avoid charges, he allegedly refused to pay.
When the police officer arrived at the 7-11 store , the clerk told the officer that a man was trying to steal
a soda. The officer located the man, still inside the store. In fact, the officer reported that the accused
confronted the officer, allegedly yelling, “I didn’t steal nothing”.
The officer asked the accused man to stand by the door while he spoke with the clerk but the accused allegedly continuously interrupted the clerk, yelling, “you’re a lying ass b….” and “I ain’t steal nothing”.
Another officer arrived and the police report that they warned the accused man to quit interrupting because it was interfering with the investigation.
The clerk told his story to the officer. The clerk said that the accused, identified as Demonte Sample, entered the store and ordered food. When the food was done cooking, Sample began to pay for the food but was upset with the clerk due to the length of time it took to cook the food. Sample allegedly told the clerk that he should get a twenty ounce Sprite for free for the delay. The clerk claims that he told Sample he was not authorized to provide a free Sprite.
The clerk claims that Sample ignored the fact that he couldn’t have the Sprite for free and allegedly
placed it in his bag and exited the store. The Clerk called the police and then told Sample he was stealing
the Sprite. Sample returned to the store but left the food and Sprite in the car.
Sample had a somewhat different interpretation. He allegedly told the officer he paid for all his items
and claimed the clerk was “being a bi…”. Sample retrieved the bag and receipt from the car, in the
process waking up his sleeping girlfriend. Sample’s receipt did not include the Sprite, which was in the
The store clerk agreed that if Sample paid for the Sprite there wouldn’t be any charges. Sample was
asked to pay for the Sprite. The officer alleged that he asked Sample as many as ten or fifteen times to
pay for the Sprite and avoid charges.
Sample allegedly refused to pay repeatedly. His girlfriend entered the store and said she would pay for
the Sprite. When she went to retrieve money from the car, Sample allegedly stated, “Y’all some b…. ass
N….”. He allegedly began opening his food containers while stating “I don’t even want this sh..
The police allege that Sample threw a chicken wing on the floor and stated, “I ain’t even picking that sh..
up”. He was advised that if he didn’t pick up the food and pay for the Sprite he would be arrested.
Sample allegedly put his hands behind his back and said “y’all gonna have to take me to jail then”.
The police started that his statement didn’t quite match his actions because when the officer attempted
to place Sample in handcuffs, he tensed up and was allegedly resisting the officer’s attempts to handcuff
him. The officer claims that he told Sample to quit resisting and after a brief struggle, he was cuffed. When he was outside, Sample allegedly did not cooperate with the command to get into the squad car, refusing to put his feet inside.
The police had a third unit respond and claim that Sample continued to struggle as the officers worked
to get him into the squad. The store clerk signed a complaint for retail theft and for disorderly conduct. The police signed a complaint for resisting a police officer. Sample is a 25 year old black male who provided a Chicago address to officers.
