A police officer named a suspected driving under the influence case after timing a car traveling 67 mph in a 35 mph zone near 109th Street on Pulaski Avenue two days before Christmas.
The officer reported witnessing the driver swerve to the right and cross over the white lane markers twice. According to the officer, the driver stopped abruptly in the 111th and Pulaski intersection to avoid colliding with another car. The officer then stopped the car.
The driver, Raymond Smith, allegedly slurred his speech and was difficult to understand according to the officer. However, Smith did allegedly admit to drinking earlier in the day. He allegedly admitted to drinking a couple of “lite” beers but corrected himself to tell the officer is was two eight ounce Miller High Lite Beers.
According to the officer, Smith displayed glassy and bloodshot eyes and an apparent injury to his right eye. The officer had previously noted a strong smell of alcohol and he alleged that Smith swayed as he exited the vehicle.
The officer claimed that Smith was unable to recite the alphabet completely and after a few letters began speaking what he termed “rubberish”. When asked to complete the one leg stand test, Smith allegedly lost his balance and fell forward toward the officer.
Despite his alleged failures in the testing process, Smith told the officer, “I ain’t trying to get a DUI.” Smith also offered to walk home according to the officer.
Smith refused to take the preliminary breath test and reportedly told the officer he would fail the test. He was placed in custody for the suspected DUI and aggravated speeding. The officer also claims he discovered a partially consumed 750 ml bottle of Tequilla from inside the pocket of the back of the front passenger seat.
At the police station, the police told Smith to pay attention to what was being explained and he allegedly replied, “I hear everything you are saying.”
Smith was adamant that the officer should not say that we drunk as he was filling out the report. When the officer said that Smith was intoxicated and impaired, he allegedly agreed with that description.
Smith was charged with DUI, aggravated speeding, improper lane use, and illegal transportation of alcoholic liquor. Smith is a 49 year old black male who provided a Dixmoor address to the police.
