A driver accused of driving under the influence allegedly put his hands behind his back and told the officer “book me”.
On Friday the 15th, a car was not moving from the intersection of 95th and 54th Avenue. The officers on the scene reported that the driver, James Mitchell was asleep at the wheel when they arrived.
Mitchell allegedly was not very compliant at first when officers asked him to step out of the car but eventually he did step out of the car and agreed to walk to the Freshline parking lot to perform field sobriety tests that the officers thought were warranted after finding him asleep.
Mitchell allegedly stumbled as he walked, dragged his feet and lost his balance according to the police. As he was offered field sobriety tests, he turned around, according to the police, placed his hands behind his back and shouted “book me” for approximately a minute.
The police claim that Mitchell then said that if they weren’t going to book him he was free to go, apparently citing some unknown rights of accused drunk drivers. The police reported that Mitchell then started to walk away from the officers.
The police did not agree with Mitchell’s book me or release me demand and handcuffed him. At the police station, Mitchell allegedly told the officers that he had four DUIs in Minnesota.
Mitchell also allegedly made other comments including bragging about being a “Fu..ing union plumber” and admitting that he went for a couple of beers.
When Mitchell was asked if he would blow for the breathalyzer, his one man comedy act continued. He allegedly told the police, “No. Ask my wife to blow, I only lick.”
When Mitchell made his one phone call to his wife, she didn’t answer causing him to lash out at the Mrs. stating, “Ha! She probably figures I’m drunk at a bar. F-word this C-word. Divorce her!”
Later, Mitchell claimed that he was not drinking. However, when it was time to be photographed he refused claiming, “I’m not getting photographed.” He then leaned against the wall with his eyes closed according to the police. When the officer offered the choice of remaining in jail or being photographed, he wisely chose to be photographed.
Mitchell, a 47 year old white male, with an Oak Lawn address, was charged with improperly parking on the roadway, illegal transportation of alcohol in an open container, failure to provide proof of insurance and driving under the influence of alcohol.
It could not be confirmed that Mitchell actually has four DUIs in Minnesota.
